What a crock. Getting real tired of these anti American pricks making making new laws and destroying the country that was established by our forefathers. Where in all our laws and constitution does it give them these privileges? We have Washington lawmaker discussing making life better for predators in Washington right now. Guess what that will bring to this state and out to the peninsula. They must be hitting the peace pipe in Port Angeles To say they want to set a new standard that aligns with world views and basicly takes our sovereignty away is treason in my book. The forefathers would have tarred and featherd them and thrown them in the bay. Federal government needs to rethink the sovereign land and fringe benefits. Because soon we will all be foreigners in OUR OWN LAND at this rate. Did the tribes offer Lindsey his own teepee?

Elected officials here have no backbone because they are mostly libtards that take orders from other libtards. They do not know how to sharpen pencils which takes a little skill,it is much easier for them to just vote for higher fee's & taxes then go to joshua's for lunch and brag about what a good job they are doing.

I know it's frustrating, I pull my hair out, but the best way is to vote in the people who oppose the unfair treaties that were made over 100 years ago. Treaties that need to be amended to the present day economics. Trump is doing some of this for us. We need to start with voting in our best candidate for 2026 - Jake Seegers.

There is a definition of Net Ecological Gain in the Wa Dept of Ecology Shoreline Master Plan handbook:

Simply stated, the no net loss standard is designed to halt the introduction of new impacts to shoreline ecological functions resulting from new development...

The proposed definition for NEG in the state of Washington is as follows:

NET ECOLOGICAL GAIN (NEG) MEANS THAT AFTER DEVELOPMENT, THERE IS AN INCREASE IN BIODIVERSITY OR RESILIENCE THAT IMPROVES THE DELIVERY OF VALUED ECOSYSTEM FUNCTIONS IN THE AFFECTED ECOSYSTEM.

https://washacad.org/wp-content/uploads/2020/04/WSAS-Net-Ecological-Gain-Report-Combined-final-July-2022.pdf

An extremely alarming condition of NEG is getting TRIBAL CONSENT BEFORE A PROJECT MOVES FORWARD. That is too much power over the affairs of Clallam County homes or businesses. To me, it is essentially “CC developmental gill netting”. The ability for JST to interpret NEG to their advantage is obvious. JST itself, would not have to adhere to the ANY STANDARDS of NEG. For this idea to even make it to the Commissioners table is obviously fishy. I vote a HUGE NO for the Tribe to have a finger in the pie!

Is it the city’s Comprehensive Plan or the JST Comprehensive Plan that is being mimicked?

Below is the 2016 Jamestown Comprehensive Plan. It includes the same elements as the city’s Comprehensive Plan. It appears the JST 2016 Comprehensive Plan is right on target and supported by the 2026 20 yr blueprint Comprehensive Plan of the city. There is too many interlacing implementations for comfort.

https://jamestowntribe.org/wp-content/uploads/2018/05/Comprehensive_Plan_Revised_in_2016_Final.pdf

“The Comprehensive Plan is the Tribe's road map. It tells us where we expect to end up, and how we intend to get there.”

Land Area Definitions:

TRIBAL LAND CONSOLIDATION AREA. (map on page 14) This area was approved by the United States Department of the Interior as the place in which the Tribe will concentrate land acquisition and economic development efforts, and within which lands may be designated as Tribal trust land

CEDED AREAS The Ceded Area is the land which was ceded to the United States when the Point No Point Treaty was signed by the Klallam, Chimacum and Twana peoples in 1855

USUAL AND ACCUSTOMED AREA (maps on pages 17) This area, also defined by the Point No Point Treaty of 1855 (the text of which is printed beneath the map on page 16), is the area in which rights to fish, hunt and gather were retained when the Tribes ceded the land to the United States.

The Jamestown S'Klallam Tribe initially acquired roughly ten acres of fee lands in Blyn in 1986, which it then had CONVERTED TO RESERVATION LAND for the Tribal Campus and future Casino. It has been the Tribe’s intent from that time forward TO CONTINUE ACQUIRING LANDS FOR REBUILDING THE TRIBE’S LAND BASE FOR FUTURE DEVELOPMENT AS THEY BECOME AVAILABLE: for instance, by in-filling between the Campus and the southwestern edge of the Blyn basin.

Although Tribes are not required to plan under Washington State’s Growth Management Act, and although our reservation lands are not subject to the jurisdiction of Clallam County or the State, ANY DECISIONS MADE BY CLALLAM COUNTY OR THE STATE WITH RESPECT TO OUR FEE LANDS WILL HAVE AN IMPACT ON OUR ABILITY TO UTILIZE THOSE LANDS IN THE FUTURE.

Expand full comment
Jennifer's avatar

Understanding how the tribe can continue to acquire lands takes a basic understanding of Fee to Trust Lands Acquisitions then ultimately a Tribal Reservation Proclamation.

https://www.bia.gov/bia/ots/fee-to-trust

Reservation Proclamations

A “reservation proclamation” is a formal declaration requested by a Federally Recognized Tribe that certain lands are proclaimed as a new reservation or an addition to an existing reservation.

Land included in a reservation proclamation must be held in trust status by the federal government. If land included in a reservation proclamation request is not trust land, a fee to trust acquisition and reservation proclamation can be processed concurrently.

The Tribe’s Plan is that transportation safety be timed with Tribal Land Development. Are the proposed roundabouts about safety, or are they about funneling business into the future Tribal business? (A Convention Center and proposed 101 Truck Stop)

https://jamestowntribe.org/wp-content/uploads/2018/05/Comprehensive_Plan_Revised_in_2016_Final.pdf

Transportation (Pg 27-28)

Much of our Tribal commerce and development will depend on the capability of US Highway 101 to function efficiently as a regional traffic corridor, and provide safe local access. Safety improvements on the corridor SHOULD BE TIMED WITH TRIBAL LAND DEVELOPMENT. Traffic safety is a continuing concern.

Safety projects were identified in the Tribe’s transportation plans and priority list. However, only two (the Pedestrian-Service Cart Tunnel and the Jimmycomelately Creek Relocation) HAVE BEEN FUNDED AND IMPLEMENTED.

In Blyn, non-motorized service will improve when the Olympic Discovery Trail is completed, and we HAVE SUCCESSFULLY RECEIVED FUNDING and completed several sections of the trail through Blyn, with more in the planning stages

Good heavens, Orca man is at it again? The Community Socialist wants to turn over decision making to local tribes because...what? They already have sovereignty. That have the wherewithal to make copious amounts of money via legal gambling and a tribal justice system that is virtually untouchable by outsiders. They rule their own government and now LSW wants to allow them, for whatever perks it may offer him and his council (and we all know that it's HIS council), so that they have a say in what you, Port Angelenas, are coughing up ever increasing amounts of your money for? You're going to be dragged into whatever presentism concoction he dreams up next because he'll wag his little fin until you do his bidding. Maybe it's time for him to have a change in costume. Lindsey is a UN, ICLEI, tribal nations grade ambulance chaser.

He and any council members who follow him are about to commit political hari kari, and bankrupt the city as they back it into a proverbial litigation buzzsaw.

Going first in the nation will bring in legal guns from around the country because of the implications, and bring Lindsey his second "legal" bloody nose in his career. He's about to burn his bridge with the non-tribal public. Next stop, he'll be hired by a tribe as an attorney, or find a job under Ferguson's administration and push more of this international agenda on the state.

AI:

This is a complex legal question with no definitive, simple answer, as it involves the intersection of tribal sovereignty, international law (FPIC), and state constitutional law (equal protection).

While the concept of Free, Prior, and Informed Consent (FPIC) grants a de facto veto power to indigenous nations in international human rights law, its inclusion in a municipal master plan in the United States would face significant legal challenges under the Washington State Constitution's equal protection clause.

Here's a breakdown of the key considerations:

⚖️ Equal Protection and Tribal Status

The Washington State Constitution, like the U.S. Constitution's Fourteenth Amendment, prohibits laws that treat one class of people differently from another without a rational basis.

* Political Classification, Not Race: The key legal precedent is that the relationship between the federal government (and by extension, state and local governments) and federally recognized Indian tribes is a political relationship, not a racial one. This political status, stemming from the tribes' original sovereignty and treaty rights, generally means that laws treating tribal members differently from non-members are not automatically considered racial discrimination and do not typically violate equal protection.

* Sovereign-to-Sovereign Distinction: Providing unique consultation or consent powers to local tribal nations is legally viewed as recognizing their pre-existing sovereign status, which predates the state itself. Federal and state courts have consistently upheld laws and agreements (like tribal gaming compacts) that grant rights exclusively to tribes, against equal protection challenges, because the classification is based on political status and the trust relationship, not race.

🏛️ The Veto Power Challenge

The proposal's provision that grants absolute authority to approve or veto city projects is where the challenge to equal protection would likely arise.

* FPIC as a Veto: FPIC grants tribes the right to withhold consent, which is a powerful form of authority far exceeding standard municipal consultation requirements.

* The Delegation of Legislative Authority: The core legal issue is whether a city council can lawfully delegate its sovereign legislative and decision-making authority to an external governmental entity—even a sovereign one—in a way that impacts all city residents.

* The Washington State Constitution mandates that local governments exercise their powers in a way that serves the interests of all their constituents. Delegating an absolute veto to one group (even a sovereign one) could be challenged as an unlawful delegation of power that disproportionately affects the rights of non-tribal residents and property owners in the city.

* Risk of Ultra Vires: A court might rule the provision "ultra vires," meaning beyond the legal power or authority of the Port Angeles City Council to enact, regardless of the equal protection challenge.

📝 Conclusion on Legal Viability

While treating federally recognized tribes as sovereign political entities does not typically violate equal protection, granting them an absolute, perpetual veto over all municipal projects would likely be found unconstitutional by a state court.

The most likely ground for invalidation would be that the city unlawfully delegated its core governmental power to an external body, potentially violating both the equal protection clause (by creating a fundamentally unequal political process) and the general principles of municipal governance in Washington State.

* Current US Practice: While consultation and accommodation with tribal nations is required by federal and often state law, the US federal government currently interprets the FPIC principle as a "call for a process of meaningful consultation with tribal leaders," rather than an absolute power of consent/veto.
