The commissioners did not answer yesterday's question asking whether their current harm reduction approach is working or just enabling people to stay in addiction.

Here is today's email to the commissioners:

Dear Commissioners,

At the recent Public Safety Town Hall, Commissioner Mike French stated that the public needs to take back parks and public spaces by using them again. If that is the County’s position, why has Clallam County been unable or unwilling to prevent ongoing encampments, loitering, and open drug activity directly around the County’s own Health and Human Services building in Port Angeles?

How can the County reasonably expect families, taxpayers, and ordinary residents to reclaim public parks when the County itself appears unable to maintain order, safety, and accessibility on property under its direct control?

Steve O.'s avatar

Jeff thanks for your hard work and dedication. I subscribe to the "Slippery Slope" model of History. The good news is that Clallam County is far superior to the county in California I left 12 years ago. The bad news is that the politicians and government bureaucrats here seem exactly the same.

Steve O.'s avatar

When I lived in LA County the local politicians didn't reside inside the hell-holes their policies produced. For two decades I worked in South Los Angeles yet one of the representatives lived in Hancock Park. Diogenes searched the city of Athens searching for "one honest man". If he visited Sequim today he would observe several honest men and women. I believe that honesty will prevail and we should be grateful to the "Watchdogs".

Would like to see John Worthington take over from Ozias.

MK's avatar

John runs circles around Ozias with knowledge. It's not even a close call. The difference is the John actually cares about what it takes for the salmon to recover.

Eve So's avatar

Wouldn’t that be amazing! Or as water steward.

Steve O.'s avatar

Billy T Wilson I would also. The thought processed in John Worthington's writing indicates to me not only a superior thought process but a better political philosophy. I believe that without a strong middle class unburdened by excessive taxation both of the extreme poor and extremely benefit.

Steve O.'s avatar

John should run as a Democrat and defeat the weaker Democrat commissioner.

First Amendment proponent you say?

*** AI ***

The **Municipal Research and Services Center (MRSC)** of Washington provides specific guidance for public entities struggling with meeting decorum—especially when past practices have been inconsistent or "selectively controlled."

When a public body has allowed non-disruptive behavior in the past but silenced certain speakers based on their message, they have likely engaged in **VIEWPOINT DISCRIMINATION**, which is a VIOLATION of the FIRST AMENDMENT.

.

Here is the MRSC’s recommended framework for rectifying this and establishing legal, enforceable rules.

## 1. Move from "Decorum" to "Disruption"

The MRSC advises moving away from vague rules targeting "impertinent," "slanderous," or "boisterous" remarks. Courts have repeatedly found that the public has a right to be harsh, critical, or even use vulgarity when addressing their government.

* **The Recommendation:** Rewrite rules to focus exclusively on **disruptive behavior**—actions that physically or audibly prevent the meeting from continuing—rather than the **content** of the speech.

* **The Legal Threshold:** If a person is speaking calmly but saying something the board "doesn't like," they cannot be silenced. If they are shouting over others so the meeting cannot proceed, they can be disciplined.

## 2. Adopt Written, Content-Neutral Rules

If your entity has been "playing it by ear," the MRSC recommends adopting formal **Rules of Procedure**. To be legally defensible, these must be "content-neutral" and "viewpoint-neutral."

| Recommended Rule Type | Purpose |

| **Time Limits** | Limits all speakers to a set time (e.g., 3 minutes) regardless of their topic. |

| **Address the Chair** | Requires all remarks to be directed to the presiding officer, preventing back-and-forth arguments with the audience. |

| **Subject Matter** | Restricts comments to items within the jurisdiction of the body (this must be applied equally to all). |

## 3. Correcting Past Selective Enforcement

If the entity has "opened the door" by allowing certain off-topic or critical speech for some but not others, the MRSC suggests a "reset":

* **Acknowledge and Reset:** At the start of a meeting, the Chair should announce the new, consistent enforcement of rules.

* **Consistency is Shielding:** The MRSC emphasizes that "consistency is the appearance of fairness." If you give one person an extra minute because you like their idea, you have legally lost the right to cut off the next person at the 3-minute mark.

## 4. The "Three Warnings" Rule

Before removing a member of the public—which is a high legal bar in Washington—the MRSC suggests a "Three Warnings" approach:

1. **First Warning:** Remind the speaker of the specific rule being violated (e.g., "Please direct your comments to the chair").

2. **Second Warning:** Explicitly state that continued behavior will result in removal or a recess.

3. **Final Action:** If the meeting truly cannot continue, the Chair may call a recess to allow tensions to cool or, as a last resort, order removal for *actual disruption*.

### Critical Caution on "Defamation"

The MRSC warns public officials that they should **not** attempt to police "slander" or "defamation" during public comment. Whether a statement is defamatory is a complex legal determination for a court, not a presiding officer. Silencing someone because you believe they are lying about a public official is a high-risk move that often leads to First Amendment litigation.

> **MRSC Best Practice:** "The chair must not under any circumstances enter into back-and-forth exchanges with the public. This response must not degenerate into lecturing or criticism."

Thanks, MK for presenting this here for us. VIEWPOINT DISCRIMINATION seems to be problematic for Clallam County Commissioner and board chairman Mike French. Now, as he asks for our vote, he espouses free speech, open public meetings, and really wanting to listen and learn, while only allowing public comment to the extent REQUIRED by law. He admonishes 'we the people' as not understanding the intent of the "founders" of the Declaration of Independence. Another example of his superior intellect and elite status to rule over his serfdom. How can he interpret the desires of his constituents when he believes we are not educated, or brainwashed, to his level.

42.30.010 - Legislative declaration.

¶The legislature finds and declares that all public commissions, boards, councils, committees, subcommittees, departments, divisions, offices, and all other public agencies of this state and subdivisions thereof exist to aid in the conduct of the people's business. It is the intent of this chapter that their actions be taken openly and that their deliberations be conducted openly.

The people of this state do not yield their sovereignty to the agencies which serve them. The people, in delegating authority, do not give their public servants the right to decide what is good for the people to know and what is not good for them to know. The people insist on remaining informed and informing the people's public servants of their views so that they may retain control over the instruments they have created. For these reasons, even when not required by law, public agencies are encouraged to incorporate and accept public comment during their decision-making process.

People tend to not do well when put into positions of power and there's conflict. Mike could have worked with this, he chose control instead.

Evrita Romero's avatar

Well done, maybe this should be emailed to everyone of those commissioners.

Susie Blake's avatar

The PA council meeting comment rules are inconsitently enforced as well.

Also the various county boards and comisssions do not apply the rules uniformly. The planning comission has beem requiring speakers to state their address, which seems wrong to me.

Susan C Bonallo's avatar

Of course they don’t apply rules evenly. It’s that very action that has made them the sleazy political being that they are. Comes with the job, to get along you must drink the kool aid!

Good one today, Jeff. John also believes that a pornographic live feed that suddenly appeared twice on the video screen during a BoCC Regular Meeting was allowed deliberately in order to justify the cancelation of public video comments. The timing of it all was too questionable. French's past actions and comments don't align with his new mantra. He needs to be consistent and explain why his views have changed and that he will continue to advocate for 1A thru his actions. Where I formerly worked, I overheard a teacher explain the First Amendment to a student. She told him it's only about thoughts, not about words spoken or written. Now that is scary!

I still can't get that disgusting site out of my mind.

Wouldn't it be great if citizens could arrest these commissioners and try them in a "people's court"? The problem with these miscreants is that they are unaccountable! They've quietly stripped consequences for their ethics violations and the courts are as corrupt as they are. If this was happening 100-150 years ago, they would be lynched.

Clallamity Jen's avatar

If he is a free speech absolutist, why didn’t he give people the opportunity to exercise free speech last week when he was available? Decisions didn’t have to be made when Ozias and Mielke were gone, but couldn’t the available commissioners have allowed public comments during the regular scheduled meeting times?

Evrita Romero's avatar

Isn’t it amazing when they start preaching freedom of speech when they’re coming up for reelection? It reminds me of that song in the best whorehouse in Texas, the governor singing I love to do a little side step cut a little strut and lead the people on..

Kristin's avatar

What really kills me is these current commissioners are behaving exactly like what they claim to be against. It is truely mortifying.

MK's avatar

I don't understand how it really operates as in why does Mike run the comments section and not Randy who I can't imagine would be this way.

Susie Blake's avatar

Mike is chair of the BOCC

MK's avatar

Ah, that makes sense.

Michael Heath's avatar

Great comment, Patriot Kristin~!

In the criminal law process of analyzing guilt, it is commonly known that the accused often reveals his/her very criminal Intent by their well organized and stated description of the very crime that they are accused of~! These commissioners' mere claims that prove that they know how NOT to behave, in fact convict them when they are subsequently proven to have acted in that very same way that they knew was wrong~! They themselves remove the "I didn't know" excuse, because they in fact prove that they DID know what they were doing was wrong all along~! No one can well describe a criminal act, only later to use the excuse that they didn't know that they were committing that same criminal act ;-)

Have a wonderful evening~!

Sincerely, Mike

Good morning Jeff and Doggers,

Mike the Chameleon. If anyone has been in tune long enough , we all know the turncoat 1A advocate. I still think we should use his own words against him and show a little property damage to make our voices amplified. The only problem with that is we the common sensers have "sense" on our side and refuse to lower ourselves to loony levels...

Freedom of speech as long as it's in alignment is not freedom at all Mike.

Thank you and I wish you all a great day!

John Worthington's avatar

Thanks Jeff. Mike will let you talk but he just doesn't listen. It goes back to Chapman, Tharinger and Doherty. The hidden agenda you don't know about and can't stop.

The party of swastika signs doesn't want an Administrative Procedure Act (APA) process for the NODC, which is the functional equivalent of an agency. They want this internationally leveraged agency decide everything for us.

The banning of background screens was rooted in the misclassification of what actually goes on over there at NODC. They started with denying screen share. They actually gave Eberlie access to their system to show flooding pictures. Then they let me do it one time. Then they denied me after it wasn't going the way they wanted. Then I pivoted to cycling back ground screens. That didn't sit well with Ozias as his nose started to grow right before our eyes. Then they totally orchestrated some fictitious zoom takeover and decided to block our background screens...not theirs. Then I brought pictures in, and that didn't sit well with the wife, who spit pea soup at me in the hallway for showing her my pictures. I broke the free speech absolutist's picture embargo.

From my wife, Kathy:

Thus far, I’ve restrained myself from commenting because I didn’t want to derail the conversations happening in this space with something that felt “off topic,” but seeing this quote from Mike French in today’s article changed my mind: “The most amazing thing to me is, they really think their nonsense should be convincing. Like, if the Board of Health had had a public hearing and let them voice their positions, the decision would’ve been different?”

The most amazing thing to me is the arrogance and indifference of leaders –at every level– who are entrusted with the legal duty to listen to and protect their constituents. Many are so convinced they are right that their response to “disfavored views” is to ignore or belittle others, rather than spend one moment in humble consideration that they might have something to learn from someone else’s painful experience.

To be fair, it’s not just Mike. For 5 years, I’ve patiently presented data and testimonies of our neighbors who were harmed by the covid shots to the CCBOH, the OMC Hospital board, my state and federal representatives, and many, many other entities.

Why go through that-- the effort, the personal rejection, friends and family who distanced themselves, loss of job opportunities, revisiting heartache? Over and over?

Because Dietrich Bonhoeffer’s quote applies to me: “Silence in the face of evil is evil itself: God will not hold us guiltless. Not to speak is to speak. Not to act is to act.”

We know someone who nearly died from an adverse reaction early in the rollout and a few months later, a King county mom did die from a similar complication because she was required to take the shot if she wanted to keep volunteering at school. Even public health authorities in WA state acknowledged it.

But what changed? Was there compassion? Research? Help in any form? A moment of clarity?

No: a doubling-down on mandates which were both unethical and unscientific, and the accompanying discrimination and destruction of communities, relationships, and livelihoods.

What followed? More deaths and injuries. More needless pain.

On Mother’s Day, I was thinking of the family of that King county mom. I was thinking of other moms and families I’ve met through this long, painful journey of trying to convince anyone who promoted the shots that they also have a duty of care towards the people –however “rare” they may be– who came to life-altering harm because of them.

It’s crickets so far.

It’s a deliberate choice not to listen, not to care, not to think, not to investigate, not to act.

Even someone like myself --who attempts engagement with nuance, reason, compassion, published research, heartbreaking firsthand experience, and practical, actionable solutions-- is treated as if I’m spouting “nonsense”.

At this point, I understand that the scale of harm is far worse than I initially imagined and I’ve met people from all over the country.

But I’m also talking about people I’ve met right here in Clallam county. Back when the PDN used to publish my letters on this topic, people would reach out to me afterwards. A woman who didn’t believe the first letter of mine that she’d read later experienced heart issues immediately after a booster and called me up to share that story. A man who’d been toting a huge pack across our beautiful backcountry told me how he can now barely cross the room. I’ve spoken at two churches and both congregations have people who were affected. A man who can’t feel his extremities. A man wondering if there’s a light at the end of the tunnel. A woman whose sweet eyes locked with mine and filled with tears when she understood that someone’s trying to help.

None of these people are nonsense.

Nonsense is the 6-foot rule, which according to Dr. Fauci’s Senate testimony “just sort of appeared.”

Nonsense is masking when you stand and unmasking to sit down and eat… because “science.”

Nonsense is wearing a mask when the cameras roll, but not before.

Nonsense is a group of powerful people deciding in a room in DC that prior infection doesn’t count as immunity because they think the American people can’t handle nuance.

Nonsense is WA’s public health authorities knowing of superspreader all-vaxxed events but continuing to discriminate against those who refuse the injections.

Nonsense is firing health care workers, first responders, teachers, and even those working remotely for refusing a shot that doesn’t prevent transmission, has injured and killed people, and for which there is no safety net when things go wrong.

But it’s not really nonsense, is it? Lives were destroyed. And those who are in power still refuse to listen.

There’s still no accountability.

For the injured, though, it’s worse. Censorship of true, documented harm was official govt policy and the abandonment of the injured and bereaved continues across two administrations.

For myself-- after years of advocacy for the injured, witnessing and experiencing immense cruelty, coming alongside to help people whose physical suffering is compounded by the trauma of being censored and abandoned, and being deeply inspired by the perseverance of those within the injured community who refuse to let others suffer alone:

It is my humble opinion that no one should be in a position of power who chooses to prop up their personal ideology and position at the cost of enabling intense suffering to continue in the lives of precious human beings who did nothing wrong, other than to trust people and systems that are not trustworthy.

I'd assert that we have juvenile leaders, to steal a concept from David's last article.

David Zelenka's avatar

Steal away! The only reason I started the flurry of recent essays is to somehow contribute and help a speedy end to the nonsense.

Michael Heath's avatar

Thank you, Patriot David Zelenka~!

You have a remarkable wife :) Your efforts have made a positive difference, even though we know how if often feels frustrating beyond belief~! However, things are FAR better and more encouraging than it would seem by the current optics. Due to the complexity of this very old evil that "we" are fighting against, a "speedy end" to this oldest of wars against humanity is unfortunately not possible, however very clearly "we" are winning and winning we must because losing is not an option for The Patriots~! These criminals of humanity have already lost, but it will take some time before they are eliminated... My wife and I are here to make sure that America and Americans are protected as much as possible because it is our duty as American Constitutionalists. This is in fact the most important time in American and world history, so keep the faith and stay as healthy and safe as possible~! Things will appear to get much worse, however that is primarily because too many are not yet awake and all efforts will be expended to save as many as possible.

Very sincerely, Mike

Jennifer's avatar

Thank You Kathy, it gets to a point when one can't hold their tongue anymore!

Michael Heath's avatar

Excellent comment, Patriot Kathy Zelenka~!

We here know exactly what you are saying and what you have been through, because we have been in this old fight ourselves for a very long time now~! You have written a VERY well stated commentary about the mass murder COVID democide that is still unfolding. You are definitely NOT alone. So, you should know, that these crimes against humanity will definitely NOT go unaddressed and those who are currently suffering from the bioweapon vaccines will have the opportunity to get help. In fact, we are doing what we can to have the new medical treatments and devices revealed that may well prove to help the vaccine injured ASAP. We believe that this will indeed happen as soon as it is safe for the custodians of these treatment protocols and devices to reveal them to the general public~! Thank you for all of your heroic and Patriotic efforts! They have not gone unnoticed or unheard! We are very sorry that this difficult process is taking SO long... Keep the faith~!

Sincerely, Mike

Mike French shows up, but he really isn't there or even remotely fair!

WHAT IS SELECTIVE ENFORCEMENT OF RULES AND WHAT ARE THE DANGERS?

The dangers of selective enforcement lie in its potential to undermine the fundamental principles of justice and equality. When RULES are ENFORCED INCONSISTENTLY, it can lead to arbitrary outcomes, favoritism, and unequal treatment under the law. Individuals who present an unpopular presentation to Board members may face harsher penalties, and censorship while others escape accountability due to their social status or connections.

WITH HIS HISTORY, WOULD YOU TRUST MIKE FRENCH TO REPRESENT US , OR TO REPRESENT AND PUSH HIS POLITICAL INTEREST?

Now that french is up for election he is acting like he is going to be a good servant LOL.We already knew he would do this but the savvy do not forgive you mike for all tha bad decisions you have made and will make in the future if re elected so that is why you get the boot in your upcoming election. Then next year we will give the king pin ozias the boot and then johnson, you home wrecking hypocrites all need to lose your high paying elected jobs to elected conservatives that will keep their pledged oaths to the public to keep clallam county safe and affordable.
