The $100 Billion Contracting Loophole

A recent undercover report revealed how “tribally owned” corporations are exploiting federal 8(a) contracting preferences

Allegations of fraud in the 8(a) program

The investigation, announced by SBA Administrator Kelly Loeffler, follows the exposure of alleged fraud within the 8(a) Business Development Program. ATI Government Solutions is an 8(a) firm, which is a federal contracting program intended for small disadvantaged businesses. The specific allegations against ATI involve fraudulent “pass-through” schemes, where the company allegedly used its minority-owned status to secure over $100 million in no-bid government contracts and then illegally outsourced most of the work to other companies.

Details of the case

• An undercover video released by O’Keefe Media Group reportedly captured an ATI contract manager, Melayne Cromwell, admitting to the scheme. Cromwell was allegedly recorded saying, “pass throughs are a great thing!” and that ATI performed only 20% of the work while the rest went to subcontractors.

• The video also claims that the company exploits the “super 8(a) status” afforded to tribally owned businesses, which allows them to receive sole-source contracts of any value.

• The Department of Justice is involved in the matter.

• The Susanville Indian Rancheria launched ATI Government Solutions in 2019 to provide financial opportunities for the tribe through federal contracting

• ATI Government Solutions,  https://atisolutions.us/

UPDATE: THE INVESTIGATIONS HAVE SINCE NOW EXTENDED TO AUDITS OF ALL 8(a) PROGRAMS!!! IT HAS EXPANDED BEYOND CALIFORNIA AND INCLUDES WASHINGTON STATE.

I have been following Trump and the Tribes for a while. He has been slowly coming in through the back door by several means including cutting funding to redundant programs that Tribes collect on (double dipping) and DEI advantages. Obviously, it has led to the discovery of corrupt practices. The day when he attacks the “sovereign” issue will be coming as it is unequal and should be balanced by either the Tribes are sovereign and maintain their own economy or they are under the 14th Amendment Section 1 and will be subject to taxes. “All persons born or naturalized in the United States, and SUBJECT TO THE JURISDICTION thereof, are CITIZENS of the United States and of the state wherein they reside” Below is an article from https://nativenewsonline.net/opinion/tribal-federal-contracting-at-risk Feb 2025. Many of the tribal newspapers also refer to the growing topic of “illegal aliens”. There is CERTAINLY CONCERN and electricity in the air.

ARTICLE; “One of the most immediate risks concerns the potential reclassification of eligibility for tribally-owned businesses UNDER THE 8(a) PROGRAM. The EO’s mandate to eradicate any perceived DEI-related advantages  could result in federal agencies questioning or even REDEFINING THE ELIGIBILITY CRITERIA FOR THESE BUSINESSES. If agencies fail to recognize the political foundation of the 8(a) program, tribally owned firms may face delays in contract awards, INCREASED SCRUTINY OR LEGAL CHALLENGES TO THEIR PARTICIPATION. Proactive engagement with  federal agencies and legal advocacy are essential to addressing this risk before it escalates...Tribally owned businesses may be required to submit additional  documentation proving that their eligibility is not RACE-BASED...”

The "not me" is classic...I have used it in a brief. Worthington v. Puget Sound Regional Council.

The big question is do we violate Sherman anti trust, civil rights clauses on federal grants for the tribes to get even for a "bad relationship" that needs to be "healed?"

The next question is how do the Commissioners change our fortunes if they continue to "heal" the relationship?

Yet another question is where is the Point No Point Treaty of 1855 now? How does it get re-negotiated through economic advantages using federal money? They (Congress) actually could have done it legally by declaring the federal money was being appropriated for that reason. The Courts call that a "de jure" monopoly. But that would require extensive treaty re-negations with Congress and nobody else. Enter the NGO process that Obama perfected to evade the APA. Their Achilles heel are found in the federal grant plans which do not contain any reparation language... or economic advantage language its a 14 year case of grant fraud.

I have personally tried so many times to create better policy for this county, only to run headlong into the plot to "heal" the bad relationship...and NODC ..and SERN.

Now NODC ..and SERN have run headlong into CCWD.

Sadly, somewhere, someone said...'treaties were made to be broken' and that seems to often be the case...oaths are also meant to be ignored...'A man's word is his bond'...meaningless, unless we go metaphysical/spiritual and then a man breaking his word as bond is creating his own karmic prison, but we can't prove that.

We Can prove it when they break their oaths, renege on promises, or gaslight and lie about things publicly written or said, but sadly, we only have a corrupt voting system and a non-existent ethics system to effect change with...this is how violent revolutions come to be...powerlessness in the face of despotism and tyranny, eventually erupts and, of course, another cycle of psychopaths seeking power in the vacuum.

Looks to me like the only 'reasonable' path is to keep exposing...but also develop a prayer/meditation life focusing on what we want instead of what we got!

We wrestle not against flesh and blood (only), but against powers and principalities (in the etheric pre-material realms)...mind always comes first before the physical manifesting. We're dumbed down...but most of us are not 'stupid'!

Broken record here, but social engineering is not the business of Government and it is a path to nowhere. Can we not see the lack of logic in using discrimination to end discrimination ? I do not know why our Government creates "minorities" to pretend to champion, but there is no end game or goal to be attained in doing so. If you take this absurd policy to it's apparent goal of changing some minority grouping into a majority grouping, a new minority grouping is born. Minorities, minority groupings, minority status or call it minority-ism are all ubiquitous. There can NEVER not be minorities. All this minority-ism is not only tail chasing, but it has no/none/"0" place in Government business. Basics like infrastructure, safety and economic opportunity are the business of Government. So therefore let it be resolved on this day that transgenders who have transitioned back to their born genders get free everything from Government because their lives matter.

Hypothetical Freeway Extension for Port Angeles Access: Extending the Shelton Freeway to Quilcene

Yes, if I were tasked with building a new freeway to enhance access to Port Angeles (assuming "Port Aneles" refers to Port Angeles, the key hub on the northern Olympic Peninsula), I would prioritize extending the existing Shelton Freeway (US 101 from near Olympia to south of Shelton) northward to Quilecene. This ~25-mile extension would transform a significant portion of the current two-lane rural highway into a four-lane divided freeway, addressing persistent bottlenecks, improving safety, and boosting economic connectivity. Below, I'll outline my reasoning, drawing on traffic data, environmental considerations, and WSDOT's ongoing priorities.

Why This Extension Makes Sense

The southern access route from I-5 (via Olympia) to Port Angeles relies almost entirely on US 101, which starts as a high-volume freeway but degrades into a low-volume, winding arterial north of Shelton. Extending the freeway to Quilcene would:

Relieve Key Bottlenecks: North of Shelton, US 101 sees AADT of 15,000–20,000 vehicles/day, dropping to 8,000–12,000 through Brinnon and Quilcene—volumes too low for a full freeway in isolation but sufficient (and growing) for safety upgrades on this critical corridor. Current issues include narrow lanes, sharp curves around Mount Walker, and frequent closures for culvert replacements (e.g., recent 22-day shutdown north of Quilcene in 2023). A freeway would cut travel time by 10–15 minutes, reduce crash risks (US 101's rural sections have higher fatality rates due to head-ons and wildlife), and handle summer tourism spikes (up to 50% AADT increase for Olympic National Park visitors).

Improve Port Angeles Connectivity: Port Angeles (AADT 20,000–25,000) serves as the ferry gateway to Victoria, BC, and a tourism/economic hub. Enhanced southern access would support freight (e.g., to Hood Canal ferries) and commuters, aligning with WSDOT's emphasis on resilient corridors in their Washington Transportation Plan (WTP 2040). It would also complement recent investments like the new US 101 Elwha River Bridge (opened 2024, wider lanes for better flow).

Build on Existing Infrastructure: The Shelton Freeway (completed 1965–1974) already bypasses downtown Shelton efficiently. Extending it northward follows Hood Canal's natural alignment, minimizing new right-of-way needs compared to alternatives like upgrading SR 3 (which parallels but veers inland).

Expand full comment
John Worthington's avatar

In summary, this extension would be a targeted, high-impact move to modernize a vital lifeline without sprawling into untouched areas. It's not in WSDOT's immediate pipeline (their focus is maintenance like culvert fixes and the Hood Canal Bridge rehab), but rising traffic and climate resilience needs make it a logical next step.

Robert James's avatar

We should dig big trenches at the shore-approaches to the Hood Canal Bridge...a salmon bypass route...a shoreline fish passage...so the natives can pitchfork them out as they pass by...one trench at either end of the bridge, so there is no congestion for the inflowing and outflowing fish runs...outbound on the East and Inbound on the West! Genetic engineering would program them to go to the correct side...brain implants would 'zap' them if they got caught going the wrong way!

Problem solved!🤓

Analysis and Recommendation

Cost: SR 3 is slightly cheaper ($450–$700M vs. $550–$800M) due to shorter upgrade distance (12 vs. 25 miles) and leveraging HCB’s existing infrastructure (e.g., $51M federal grant momentum). The new bridge’s cost (~$250–$350M) aligns with HCB’s half-rebuild ($471M in 2009, ~$650M today). US 101’s longer rural upgrade drives higher costs, though overpasses add similarly to both (~$20–$60M).

Benefits: SR 3 offers higher ROI ($50–$70M/year) due to greater Kitsap traffic (30,000 AADT near HCB) and ferry redundancy (HCB’s 15–20 daily openings cause 30–40 min delays). US 101’s $40–$60M/year benefits prioritize direct I-5/Olympia access (95,000 AADT start) and rural tourism (Olympic National Park). Both cut Port Angeles travel time by 10–20 min.

Feasibility: SR 3 has an edge with active HCB investments (WSDOT’s $85M girder project starts Nov. 2025) and federal bridge funding potential. US 101 aligns with WTP 2040’s rural resilience goals but lacks current momentum. SR 3’s new bridge faces environmental hurdles (Hood Canal’s salmon habitat, tribal input from Port Gamble S’Klallam), while US 101’s existing corridor simplifies permitting (NEPA: 3–5 years).

My Pick: US 101 remains my recommendation for direct Port Angeles access from I-5/Olympia, leveraging its established corridor and lower marine/seismic risks (BCR ~1.5–2.0). SR 3 is compelling for Kitsap commuters and HCB redundancy but less directly serves southern Port Angeles traffic. If your priority is cost or Seattle/Kitsap access, SR 3’s new bridge could edge out

Recommendation for Defense and Coastal Security

Best Choice: SR 3 Upgrades with New Bridge. The SR 3 option is superior for defending bases and the coast due to its direct support for Naval Base Kitsap (Bangor’s Trident submarines are a national security priority) and faster access to Port Angeles/Coast Guard Station from Kitsap (~45–60 min vs. 1.5–2 hr via US 101). The new bridge provides HCB redundancy, critical for 30,000 daily crossings and naval logistics during disruptions (e.g., HCB’s 15–20 daily openings). Its lower cost ($450–$700M) and funding momentum ($51M INFRA grant) outweigh environmental risks, which can be mitigated with modern design (e.g., HCB’s seismic upgrades).

Why Not US 101?: While US 101 excels for JBLM-Port Angeles connectivity and Peninsula evacuation (20,000+ residents), it’s less critical for Kitsap’s naval operations, which dominate regional defense needs. Its higher cost and longer timeline (25 miles vs. 18 miles total) reduce immediate strategic impact.

If your focus shifts to specific scenarios (e.g., tsunami evacuation or JBLM deployment), US 101 could take precedence.

Which Act Prevails: Wilderness Act of 1964 vs. Americans with Disabilities Act (ADA) of 1990 for Alpine-Style Tunnels in the Olympic Mountains?

Your query focuses on whether the Americans with Disabilities Act (ADA) of 1990, described as "undefeated," would take precedence over the Wilderness Act of 1964 in enabling Alpine-style tunnels through the Olympic Mountains to improve skiing access (e.g., to Hurricane Ridge near Port Angeles) with handicap accessibility. This follows our prior discussion comparing tunnels to surface highway upgrades (US 101 extension: Shelton to Quilecene, $550–$800M; SR 3 upgrades: Poulsbo to Hood Canal Bridge with a new bridge to Port Ludlow, $450–$700M) for skiing and broader access. Here, I’ll analyze the legal interplay between the Wilderness Act and ADA in the context of a hypothetical 5–10-mile tunnel to enhance access to Hurricane Ridge or new ski areas in Olympic National Park, benchmarking against Alpine tunnels (e.g., Lötschberg, Gotthard) and addressing ADA’s mandate for accessibility versus the Wilderness Act’s strict protections.

Another excellent article Jeff Tozzer~!

I won't expand on most of the subjects here at this time, because you and SO many others here on the Clallam County Watchdog and done a great job of that already! However, with regard to the "North Fork Skokomish Trailhead" near Lake Cushman I DEFINITELY have to say something about that as an American Constitutionalist~! I do NOT now, nor will I ever, acknowledge or abide by ANY authority or domination of MY (Americas) public lands by ANY agency or entity, either foreign or domestic, so I STRONGLY advise the Skokomish Tribal Government and its members to IMMEDIATELY "stand down" from their unconstitutional outrage of attempting to prohibit any legal American from using that trail as they see fit, and whenever they so wish~! I completely reject any government, organizations, Individuals, or groups authority to dictate or control any public lands within America, regardless of political agendas, motivations, fake science BS, or any other illegal, unlawful, and/or unconstitutional schemes~! I would hope that some great "enterprising" American individuals who also took great personal offense from such a blatantly insulting and outrageous move by the Skokomish Tribal Government (or any other Individuals) would immediately "relocate" that disgusting sign that dares to prohibit and control the use of those public lands~! I can think of a number of places where that specific sign could be "relocated", as physically painful as that would be for some, however I will not elaborate upon that because I do not wish to appear "crude" on this absolutely beautiful "joy joy" Monday Fall Day~! HA~! If I wanted to use that trail however, I would do so any time that I wanted, and anyone who had a problem with that would have a FAR bigger problem to deal with~! I may not respect the owners, however I do respect others lawful Constitutional property rights, so I will absolutely demand and defend MY property rights, as well as MY absolute right to use any and all public lands within the US, regardless of the issues of "spotted owls" or any fools who may dislike my choices~! If you do not like our lawful American freedoms and rights, read the ORIGINAL American Constitution, or have someone read it to you, and get over your mentally sick self~! You people who "think" that you have some right to claim land that is NOT yours, had better think again, because there are those of us who are COMPLETELY intolerant of being abused, harassed, and bullied by fools, idiots, and morons who are violating our American and natural God given freedoms & rights~! Have a great day~!
